Original cost and acquisition date carried forward

Becoming Spanish tax resident changes how your investments are taxed.

Capital gains that may have been deferred or treated differently elsewhere can become taxable in Spain when investments are sold or switched outside the Traspaso regime.

The Traspaso regime is part of Spain’s Personal Income Tax framework. Where the conditions are met, transferring holdings from one qualifying fund to another can defer the capital gains tax liability rather than crystallising it at the point of transfer.

This service is designed for individuals who want a tax-efficient savings and investment structure, clear explanations, and access to leading Traspaso-capable investment solutions across the full risk spectrum—from cash-like and cautious approaches through to adventurous portfolios.

What is the Traspaso regime?

A Tax-Deferred Way to Change Funds

A Traspaso is a transfer between eligible investment funds. Rather than selling one fund, paying capital gains tax and then reinvesting, a qualifying transfer may allow the investor to move into another fund while deferring the tax consequences. The original acquisition cost and acquisition date are generally carried forward, so tax is generally deferred until a future final redemption.

Potential tax deferral

Switching between eligible funds may avoid an immediate capital gains tax charge.

Continued investment

More of the portfolio can remain invested rather than being reduced by a tax payment.

Portfolio flexibility

Investors may rebalance, change risk level or move between fund managers, subject to eligibility.

Tax treatment depends on individual circumstances, the funds involved, the transfer process and prevailing Spanish tax rules. The Traspaso regime is subject to conditions, including the use of qualifying collective investment schemes and, in general, CNMV-registered distribution arrangements. This website provides general information and does not constitute personalised tax, legal or investment advice.

A simple example

The Potential Effect of Staying Invested

Sarah has €100,000 invested and expects a 4% net annual return. If she changes funds every year outside the Traspaso regime, tax may be deducted from gains as they arise, reducing the amount available to compound.

Using a Traspaso-capable approach, she may be able to move between qualifying funds while deferring the capital gains tax consequence.

Approximately

€1,565

Simplified assumptions. The exact outcome depends on the funds used, timing, charges, currency, future returns and her personal tax position.

Taking income

A €4,000 Income Withdrawal Does Not Mean a €4,000 Taxable Gain

Imagine you invest €100,000 in a Traspaso-capable fund. After one year, the investment has grown by 4% to €104,000.

You decide to take €4,000 as income. To do this, you redeem approximately 4% of your fund units.

Because the fund has grown by 4%, the gain attached to the units you redeem is also approximately 4% of the total gain. The taxable gain is therefore €160—not the full €4,000 you receive.

The remaining €96,000 stays invested, including €3,840 of unrealised growth, which can continue to benefit from tax deferral under the Traspaso regime.

StepAmount
Original investment€100,000
Value after 4% net growth€104,000
Total unrealised gain€4,000
Income withdrawn€4,000
Percentage of holding redeemed4%
Taxable gain declared€160
Tax-free return of capital within withdrawal€3,840
Capital remaining invested€96,000
Unrealised gain remaining invested€3,840

You are redeeming units, not realising the whole gain

When you withdraw €4,000, you redeem a small proportion of your holding—not the entire €104,000. Those units carry about 4% of the gain: €4,000 × 4% = €160. The other €3,840 is treated as a return of your original capital.

What is declared

In this simplified example, the realised capital gain to report is €160—not €4,000. At the initial 19% savings-tax rate, tax would be approximately €30, leaving approximately €3,970 net income.

Income without unnecessarily crystallising tax

A Traspaso-capable fund can allow you to take income while leaving most of your investment, and most of its growth, untouched. This is the difference between withdrawing money and realising your entire gain.

This is a simplified illustration. It assumes that all units were acquired at the same time and cost, that the fund value is €104,000, and that a €4,000 withdrawal redeems 4% of the holding. Where units were acquired at different times or prices, Spanish tax rules generally apply FIFO: the first units acquired are treated as redeemed first. Tax treatment depends on individual circumstances, the fund and share class, the timing and size of withdrawals, total savings income and prevailing Spanish tax rules. Investment values can fall as well as rise, and capital is at risk. A Traspaso may defer tax; it does not eliminate it.
